Welcome to ComedySafeDriver.com (“Website”), operated by Comedy Safe Driver (“we,” “us,” or “our”). By accessing or using the Website and our online courses and related services (collectively, the “Services”), you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Services.

1) Acceptance of Terms

By creating an account, purchasing a course, or using any part of the Services, you agree to these Terms and our Privacy Policy, Refund Policy, and any state-specific rules disclosed during signup.

2) Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to register and complete a course. You are responsible for ensuring you are eligible to take the course for your intended purpose (e.g., ticket dismissal, insurance discount) under your state’s rules and any court requirements.

3) Services

We offer state-approved defensive driving / driver safety courses for uses that may include traffic ticket dismissal, insurance discounts, and general education. Approval and permitted uses vary by state and by court. You must confirm eligibility with your court, insurer, or other authority before enrolling. Completion does not guarantee a specific outcome with any third party.

4) Accounts & Security

  • Registration: Provide accurate, current, and complete information and keep it updated.
  • Security: You are responsible for safeguarding your login credentials and all activity on your account.
  • Identity / Validation: Where required by law or policy, you must pass personal validation, affidavit, proctoring, or similar identity checks to receive credit.

5) Pricing, Payments & Refunds

  • Fees: Current pricing is shown at checkout. Payment is required to access course content.
  • Refunds: As outlined in our Refund Policy, you may request a full refund within 30 days of purchase provided you have not completed the course (pass or fail) and none of the non-refundable circumstances apply (including failed maximum attempts, validation failures, or certificate/e-file submission).
  • Non-refundable items: Once fulfilled or submitted, e-file fees, mailing/shipping, downloadable delivery, and driving record purchases are not refundable. Processing fees may be non-refundable once settled by your payment provider.
  • 120-Day inactivity: If the course is not completed within 120 days of purchase, your registration may be cancelled and is not eligible for a refund.

6) Course Rules, Attempts & Completion

  • Progress: You must complete all required sections, time requirements, quizzes, and exams.
  • Attempts: State rules may limit the number of failed attempts (e.g., three). Exceeding the limit may result in course lock-out and no refund (see Refund Policy).
  • Certificate: Certificates may be delivered electronically, via download, mail, or court e-file (where offered). We are not responsible for delays caused by incorrect data you provide, third-party systems, or postal/court processing.
  • E-file finality: Where available, once we submit an e-filed certificate to a court, the submission is final and non-refundable.

7) Your Responsibilities

  • Confirm court/insurer eligibility, due dates, and documentation requirements before purchase.
  • Enter accurate personal, court, citation, and delivery information.
  • Complete the course on time; monitor your due dates and any court requirements.

8) Prohibited Conduct

You agree not to: (i) violate laws or third-party rights; (ii) share accounts or attempt to circumvent identity validation or time requirements; (iii) copy, record, scrape, or redistribute course content; (iv) use bots or automation to access the Services; or (v) interfere with or degrade the Website.

9) Intellectual Property

The Services and all content (text, videos, graphics, logos, course materials) are owned by us or our licensors and are protected by IP laws. You receive a limited, non-exclusive, non-transferable license to access the course for your personal, non-commercial use. All rights not expressly granted are reserved.

10) Third-Party Services

We may use third-party providers (e.g., payment processors, mailing/e-file vendors, driving record services). Your use of those services may be subject to their separate terms and privacy practices. We are not responsible for third-party outages or errors, though we will use commercially reasonable efforts to assist you.

11) Availability & Maintenance

We strive for high availability but do not guarantee uninterrupted access. We may suspend or limit access for maintenance, security, or legal reasons.

12) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT (A) THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED, OR (B) COMPLETION WILL RESULT IN ANY PARTICULAR OUTCOME WITH A COURT, DMV, OR INSURER.

13) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE COURSE GIVING RISE TO THE CLAIM.

14) Indemnification

You agree to indemnify and hold harmless Comedy Safe Driver and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your (i) breach of these Terms, (ii) misuse of the Services, or (iii) violation of law or third-party rights.

15) Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute shall be resolved by binding arbitration before a single arbitrator under the rules of the American Arbitration Association. Class actions are not permitted. Either party may bring an individual claim in small claims court. You and we agree to the exclusive jurisdiction for enforcement of an arbitration award in courts located in Texas.

16) Termination

We may suspend or terminate access to the Services for any violation of these Terms or suspected fraud, cheating, or misuse. Upon termination, your right to use the Services ceases immediately and no refunds are provided except as expressly stated in our Refund Policy.

17) Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new “Last updated” date. Your continued use of the Services after changes are posted constitutes acceptance.
